Terms and conditions for dealers

Separate contractual conditions for dealers on the web platform
of TachoControl DATA GmbH

After registering as a dealer on the TCD website’s dealer portal, the following separate contractual conditions shall apply, in addition to the contractual conditions already found on the website:

1) TCD shall be free to decide who is accepted as a dealer after registration and will confirm the dealer’s registration separately if necessary.

2) TCD shall have the exclusive right of representation for the dealer’s customers. This obligates the dealer to waive all rights of the customers named by him/her with respect to TCD.

3) The dealer shall undertake to ensure that his/her customer provides a link to the TCD website. At the same time, the dealer shall also provide a link to TCD’s website.

4) The dealer shall receive a one-time commission of 20% on goods ordered by the customer in the TCD web shop, for customers identified to TCD by name.

5) In addition, the dealer shall receive a commission of 20% on fees booked (not for SIM or telephone charges) for customers registered in the TCD web shop via the dealer’s account, but for a maximum period of 12 months from the conclusion of the contract.

6) Payment of the dealer’s accrued commissions shall be made 14 days after payment of the invoices issued by TCD to the customer. Payment shall be made from a minimum commission amount of 20 euros. Smaller amounts of up to 20 euros shall be collected and paid.

7) The payment of the commission shall be made to the bank account specified by the dealer by SEPA transfer or to the credit card provided.

8) The dealer is not permitted to offer, sell or broker competing products. Should this be disregarded by the dealer, the dealer shall lose his/her dealer status, including the right to receive commission payments, with immediate effect from the time the breach of the condition in section 1 becomes known.

9) The dealer has the right to add his/her company logo and address to the advertising brochures and to reproduce them.
